However, a plaintiff’s damages can be reduced based on the percentage of fault a judge or jury assigns to them.

Miss. Code Ann. § 85-5-7 describes limitations in Mississippi personal injury cases that involve damages caused by two or more people. In these cases, each defendant is liable only for damages allocated individually in direct proportion to their percentage of fault. Joint and several liability can be held for individuals who knowingly pursue a common plan or tortious act.

Types Of Available Damages In A Mississippi Personal Injury Case

Three types of damages are available to Mississippi personal injury case victims: economic, non-economic, and punitive.

Economic damages involve compensation for verifiable monetary losses. Non-economic damages are subjective compensation and relate to non-monetary losses such as pain and suffering. Punitive damages are awarded to deter illegal behaviors.

Does Mississippi law limit the amount of damages I can receive?

In general, Mississippi has no caps on economic damages in personal injury cases. However, the State has caps on certain personal injury damages.

There is a $1 million cap on non-economic damages and a $500,000 cap on medical malpractice damages in Mississippi, according to Miss. Code Ann. § 11-1-60. Also, punitive damages are capped based on the defendant’s net worth.

Deadlines To File A Mississippi Personal Injury Lawsuit

A personal injury legal claim must be submitted within three years of the accident in accordance with Miss. Code Ann. § 15-1-49. The three-year statute of limitations also applies to fraud and product liability cases.

For medical malpractice lawsuits, there is a two-year statute of limitations based on Miss. Code. Ann. § 15-1-36.

Claims Against Mississippi Municipalities

Miss. Code Ann. § 11-46-11 applies to claims against Mississippi municipalities. The statute indicates an individual can file a personal injury lawsuit against a Mississippi municipality within one year of the accident date. This lawsuit must be filed with the state’s attorney general, board of supervisors, or a municipality representative. Also, a 90-day notice of claim must be sent to the chief executive officer of the governmental entity.
