Miss. Code Ann. § 11-7-15 defines pure comparative negligence in Mississippi. It indicates that a plaintiff can recover damages from a defendant in a personal injury case regardless of how much the plaintiff was responsible for their injury. However, a plaintiff’s damages can be reduced based on the percentage of fault a judge or jury assigns to them.
For instance, a personal injury accident victim may pursue $10,000 from an at-fault party. If the judge determines the plaintiff was 20% responsible for the accident, this individual’s compensation will be reduced accordingly, allowing them to recover $8,000.
Miss. Code Ann. § 85-5-7 describes limitations in Mississippi personal injury cases that involve damages caused by two or more people.
