In 2020, Bayer settled 100,000 cases and unsuccessfully sought court approval to settle future cases for $2 billion, according to a Reuters report. As of January 17, 2023, 4,158 cases were still pending in the MDL.

What is Roundup?

Roundup is the most widely-used herbicide in the world and the most profitable weed killer ever sold. It is used in agriculture, forestry, lawn care, and home gardening. Glyphosate was developed by Monsanto more than 50 years ago.

What is non-Hodgkin's lymphoma?

Non-Hodgkin’s lymphoma is a form of cancer that occurs when the body produces an oversupply of white blood cells, also known as lymphocytes. While old white blood cells typically die as new ones are born, in non-Hodgkin’s lymphoma, old lymphocytes do not die. 

Glyphosate is most strongly associated with a sub-type of non-Hodgkin’s lymphoma known as diffuse large b-cell lymphoma, according to Environmental Research. Non-Hodgkin’s lymphoma generally occurs in areas of the body that contain lymph tissue, including the following:

  • Lymph nodes
  • Spleen
  • Bone marrow
  • Thymus gland
  • Adenoids
  • Tonsils
  • Digestive tract

However, non-Hodgkin’s lymphoma occasionally occurs in organs outside the lymphatic system. 

Symptoms and Complications of Non-Hodgkin’s Lymphoma

Non-Hodgkin’s lymphoma may present with the following symptoms, according to the Mayo Clinic:

  • Swollen lymph nodes in the neck, armpits, or groin
  • Abdominal pain
  • Swelling of the abdomen
  • Chest pain
  • Coughing
  • Shortness of breath
  • Fever
  • Night sweats
  • Weight loss

Long-term complications may develop as a result of treatment side effects or the condition itself, according to the British National Health Service. Complications may include the following:

How is non-Hodgkin’s lymphoma treated?

Treatment for non-Hodgkin’s lymphoma may include the following, according to the American Cancer Society:

  • Radiation therapy
  • Surgery
  • High-dose chemotherapy and stem cell transplant

Is glyphosate banned?

The Bayer Corporation has pledged to stop selling glyphosate-based products to non-commercial consumers in the United States in light of the vast number of lawsuits it is facing. However, no regulatory agency has banned or restricted its use.

The EPA has failed to acknowledge that glyphosate is carcinogenic. According to the Environmental Working Group, the EPA is underfunded. This may explain why the EPA has not performed sufficient research on glyphosate toxicity. If it had, it would have found substantial data documenting its dangers to human health.

The International Agency for Research on Cancer (IARC) hosted a working group consisting of 17 independent experts from 11 countries to analyze approximately 1,000 studies using strict parameters. They found strong scientific support for the association between glyphosate and damage to human DNA, leading to an official classification of glyphosate as “probably carcinogenic.”

On June 17, 2022, the Ninth Circuit U.S. Court of Appeals ordered the EPA to revisit its glyphosate findings, a task the EPA has yet to complete.

Who is responsible for the harm caused by Roundup?

When a product causes harm, the following parties may be responsible:

  • Manufacturers
  • Distributors
  • Retailers
  • Importers

Monsanto is the original manufacturer and marketer of glyphosate products. The Bayer Corporation purchased Monsanto in 2018. Consequently, Monsanto was dissolved, and the Bayer Corporation acquired Monsanto’s liabilities along with the company’s product lines. 

What do I have to prove in a Roundup cancer lawsuit?

Product liability may be established by proving negligence or strict liability. Under the negligence doctrine, a plaintiff must prove that the defendant caused harm by failing to use reasonable care. Under strict liability, it is only necessary to prove that the product was harmful, even if the manufacturer was not negligent. 

It is not necessary for the manufacturer to be aware that the product was harmful. It is only necessary to prove at least one of the following:

  • The product is inherently harmful
  • A product defect resulted in harm
  • Harm stemmed from a failure to provide adequate warnings or instructions

Monsanto developed and marketed an inherently harmful product in glyphosate and failed to warn the public about its dangers. Monsanto may have been aware of these dangers and actively concealed them from the public through fraudulent concealment. If this is proven, you may qualify for punitive damages.

According to the International Journal of Risk and Safety in Medicine, 141 declassified documents indicate that Monsanto unethically influenced the scientific review and publication of safety data through such actions as the following:

  • Ghostwriting articles published in scientific journals and the media
  • Interfering in the peer review process
  • Using hidden influence for retraction
  • Creating a fake academic website defending Monsanto products

Is there a class action Roundup lawsuit?

The Roundup litigation is not part of a class action lawsuit, but it has been consolidated into multidistrict litigation or MDL.

Multidistrict litigation is a procedure used by federal courts to reduce the burden on the court system when a large number of cases are filed with similar facts. The cases remain separate but are transferred to one federal court, where a few test cases are heard at trial. These are known as bellwether trials. The outcome of these trials influences the outcome of the remaining cases, ideally resulting in the cases being quickly settled. The Roundup litigation is MDL 2741, Case Number 3:16-md-02741-VC. It was transferred to the Northern District of California on October 4, 2016.
